Technical Consultant For Legislation Department

About World Health Organization

Afghanistan health system has made considerable progress over the period of 2002 -2015 because of the Ministry of public health (MoPH) leadership, sound public health policies, innovative service delivery, careful program monitoring and evaluation and development assistance. The number of functioning health facilities has increased from 496 in 2002 to more than 2000 in 2012, while at the same time the proportion of facilities with skilled female staff has much increased. Since the establishment of a new administration in 2002, the government has given utmost importance to addressing the high maternal and child mortality, especially in rural areas. The MoPH undertook a series of critical and strategic steps: it defined a Basic Package of Health services (BPHS) and later an Essential Package of Hospital services (EPHS); it established a system for contracting out on a large scale with international and national non-governmental organizations (NGOs) for delivery of these services. The MoPH also prioritized Monitoring and Evaluation (M&E) of health sector performance. Through the deployment of predominantly local consultants, MoPH addressed the human resource capacity constraints in terms of managing NGO contracts, tracking health sector progress through rigorous impact level monitoring and performing its stewardship function effectively.
Legislation Department (LD) under Directorate of Planning and Legislation (DPL) is the key department of General Directorate of Policy and Planning (GDPP) of MoPH for drafting and handling of the health related laws and regulations. Also, this department is responsible for coordination with line department of Ministry of Justice (MoJ) and other ministries in order to facilitate the process of legislations.
DPL plans to enhance the effectiveness of LD. Under this endeavour, DPL will work with the LD to identify opportunities to hire a Technical consultant (TC) in order to technically support the head of LD to effectively fulfil all responsibilities of the department. The Ministry of Public Health has therefore requested the assistance of the WHO to support GDPP to hire a Technical consultant for LD. The consultant will be on full time basis for the period of the contract.
The DPL will seek to retain a Technical consultant (Legal Consultant) with practical experience in Afghanistan Law and regulations to carry out the tasks of the position.

Job Summary

The overall objective for hiring the TC is to address the tasks of the LD’s ToR that is not achieved on time and to provide additional technical supports to the LD and facilitate the move towards Universal Health Coverage. The TC will conduct a Training Need Assessment (TNA) of the current structure of the LD and will develop a capacity building plan for LD during the initial months of his contract. The capacity building plan will clearly define the change process that will lead to improvement in capacity of LD to achieve results. Also, the plan will include activities to be undertaken and indicators to measure progress towards results.

The assignment is tentatively for a period of 1 year
The Legal Consultant shall receive payment in instalments (to be agreed) upon satisfactory completion of the above tasks.

Duties and Responsibilities

The TC responsibilities would consist of the following:
• TNA and capacity building plan for LD which clearly defines the change process that will lead to improvement in capacity of LD and assist MoPH to move towards UHC
• Assist in reviewing the legal material and any other relevant documents and to identify the most important issues that creates barrier for moving towards UHS and need to be sorted out on a priority basis of health related legislations
• Provide technical inputs for drafting health-related legislations (e.g. insurance law, revision of public health law)
• Provide technical support to LD on all the technical aspects of the department tasks, including the drafting of the legal documents, capacity building initiatives, etc.
• Provide inputs to the DPL and GDPP for briefings
• Coordinate day to day implementation of task under the Director, DPL
• Follow up of submitted drafts with MoJ and other Ministries for further process and to have regular communication with MoJ and stakeholders
• To perform any other relevant work related to the assigned by the Director, DPL and the DG, General Directorate of Policy and Planning
• The consultant will report to the General Directorate of Policy and Planning

• Strong interpersonal, documentation and report writing skills.
• Excellent written and oral English with professional proficiency in one of the official local Languages
• Proficiency in utilization of Microsoft Office, internet browsing and Email access.
• Being able to travel inside or outside of Afghanistan as required
• Excellent team player with a proven track record of working with multi stakeholder community
• Strong interpersonal, communication and presentation skills
• Command of Arabic languages is an advantage

Qualifications

The consultant is expected to have the following qualification and skills and expertise:
• Desirable: Master’s degree in Law
• Necessary knowledge about health policies for UHC and governance, health related Legislations and Policies is an advantage.
• A minimum of three (3) years’ experience in conducting organizational capacity needs assessments or training needs assessment, experience with system-assessment processes will be an advantage.
• Strong interpersonal, documentation and report writing skills.
• Excellent written and oral English with professional proficiency in one of the official local Languages
• Proficiency in utilization of Microsoft Office, internet browsing and Email access.
• Being able to travel inside or outside of Afghanistan as required
• Excellent team player with a proven track record of working with multi stakeholder community
• Strong interpersonal, communication and presentation skills
• Command of Arabic languages is an advantage

3. KEY DELIVERABLES
1. A work plan, with detailed methodology to be submitted within 7 days from the commencement of the assignment.
2. Facilitation of a validation orientation, to be conducted after presentation of the plan
3. A consolidated report which includes findings of the capacity needs assessment and agreed capacity building plan, to be submitted
4. Report on documents provided on various legislative Issues
5. Final Report including all services provided and the recommendations for the way forward
6. All written deliverables shall be in English and Dari or Pashto. Deliverables shall be provided in paper and electronic form. No deliverable will be considered as final before being approved by the DPL.
