The Customs Legal Specialist will be supervised by the Director Technical and will be responsible for assisting the ACD in reviewing and drafting of the legal procedures and processes as entrusted by him. Reporting directly to the Director Technical, the Customs Legal Specialist is expected to perform the following duties and responsibilities including but not limited to.
Providing legal advice to Director Technical Affairs regarding Customs law and other law issues relating to Customs law and procedures and other laws of Afghanistan.
Will assist ACD in carrying out a comprehensive review of the existing Customs Law, including review of already drafted amendments, with a particular emphasis on preventive and enforcement aspects. The Legal Specialist will also review the relevant constitutional clauses and Laws/Acts of other Government ministries and departments specifically pertaining to law enforcement, with an aim to identify overlaps and /or contradictions with the Customs Law, and suggest appropriate amendments where applicable.
Writing legal opinions and briefs for ACD Senior Management regarding questions raised from GIRoA (local) laws and reviews program material for soundness and accuracy with respect to local laws. The Legal Specialist assists the Legal team and technical officers, as requested, in the design and implementation of activities.
Assisting Director of Technical Affairs in Customs Law amendments, drafting procedures and SOPs as and when required.
Tracking legislative and regulatory initiatives and prepare reports on executive and legislative activities/developments.
Participating in working groups to develop implementing procedures for tax and customs exemptions including analyzing and drafting modifications to local laws.
Assisting Director Technical Affairs in the creation, review and analysis of memorandums of understanding, interpretation of bilateral agreements for customs affairs,WTO,SAFTA and other International Conventions, Treaties and legal documents as and when required.
With prior intimation and approval of the competent authority, obtain information through direct liaising with senior Government officials including key ministries and Parliament authorities, also maintaining contacts with members of the private bar and judicial officials on matters of local law.
Assisting the Director of Technical Affairs of Customs in reviewing various issues for compliance with Afghanistan law including disposition of assets/property issues, source, origin, nationality, participant training, bilateral issues, waivers and tax and customs questions.
Drafting proposal letters to Ministry officials and providing advice on political ramifications and also advising project personnel on their proposed contacts with government officials and donors, e.g., what approach to apply, and what to look for or to avoid.

Bachelor’s Degree, or equivalent, in Law in Afghanistan. Master’s degree holders will be given preference.

b. Work Experience and Computer Skills
Minimum 5 years of professional relevant experience relating to Constitutional, Customs, and Administrative Law.
Should have sound working knowledge of international treaties, conventions, agreements e.g. WCO, WTO etc
Minimum of 3 years’ experience for candidates with Master ‘s degree
Experience in legal and policy analysis in the areas of Customs law and other law issues relating to Customs law and procedures and other laws of Afghanistan.
Excellent command of both oral and written English is desirable.
Excellent command of both oral and written, in at least one of the local languages (Dari and Pashto) required.
Excellent knowledge of office applications and important computer programs are required.

Selection & Probation Period
Selection will be done on the basis of the World Bank guidelines and procedures.
The selected candidate will be initially offered nine months contract, and would be on probation for first month of joining, after which he/she will be confirmed subject to his/her satisfactory performance.
