TAPI Legal Advisor is responsible for all legal matters of the TAPI project, reviewing the documents, agreements, and contracts and making sure that it is in compliance with the national and international laws. Coordinate with ministry legal department and other stake holder’s legal team. The Legal Adviser will work closely with the TAPI Director.
He/she will provide technical expertise and policy guidance on legal issues into the design and implementation of the Project. A candidate with a good understanding of both technical and institutional aspects of legal issues, in the Afghanistan context, will be desirable.
The terms of reference shall be, but not limited to, the following:
1. Assist TAPI Director with overall development and implementation of the Project with particular reference to all legal aspects of program management and project implementation, procurement and contract management; agreements, preparation and briefing notes on technical and board meetings of the TAPI.
2. Assist TAPI Director in checking overall performance of the consultants, carrying out field visits see their work, supervision of construction contracts, ensuring quality of construction is maintained according to the specifications as included in the bidding documents and that the Project Implementation Consultants (PICs) perform construction supervision according to the designed schedule;
3. Verifying how the measure against collusion, forgery, frauds etc, are being implemented in case of works contracts and checking the adequacy of these measures and reporting to the TAPI director and MoMP seniors and project auditors any irregularities in these procedures;
4. Assist in comparative legal analyses, resolution of legal and policy issues, research relevant precedents, and propose appropriate solutions;
5. Review documents for adherence to ADB's and GoA's legal, procurement policies and procedures;
6. Prepare briefs on diverse topics as required and participate in task/project team works;
7. Provide legal advice to clients on legal and policy issues;
8. Follow up with relevant Ministries on project related issues;
9. Review and provide legal advice, review documents, draft legal documents, procedures, and policies as per plan and project needs.
10. Review ongoing cases and advice management accordingly.
11. Liaise with relevant departments to ensure that where legal risks have been identified, appropriate courses of action have been taken.
12. Provide legal protection and risk management advice to management especially on contract management, agreements and other tasks and issues as and when it is arise.
13. Provide and interpret legal information, conduct training and disseminate appropriate legal requirements to staff.
14. Review and advise management on legal implications of internal policies and procedures.
15. Review and draft contracts, agreements and internal policies and ensure that they are in compliance with all statutory or legal requirements.
16. Perform other tasks assigned by the TAPI Director;
At least bachelor degree in law and Master Degree is highly preferred in this field.
Minimum 5 years of relevant work experience.
Knowledge of Afghan Government and International legal procedures
Excellent written and oral communication skills in English, Dari/ Pashto
Able to maintain records, and prepare reports and correspondence related to the work.
Team player with solid analytical and creative problem solving skills.
